Terms and Conditions
Welcome to Park City Prefab Works. By purchasing products or services from Park City Prefab Works, LLC (“Park City Prefab Works,” “we,” “our,” or “us”), you agree to the following Terms and Conditions.
These Terms and Conditions govern the purchase and use of Park City Prefab Works documents, plans, prefab packages, and any related services.
1. Design Protection and Derivative Works
All Park City Prefab Works designs are protected under applicable intellectual property laws. Modified or adapted versions of our designs may not be commercialized, resold, reproduced, or reused beyond the scope of the single-build license provided.
2. Manufacturing and Fabrication Rights
Park City Prefab Works designs may not be used to manufacture or distribute building systems without prior written authorization.
This restriction includes, but is not limited to:
- Prefab homes
- Modular systems
- Panelized systems
- Structural kits
- Off-site assemblies
All rights to produce prefab or manufactured systems based on Park City Prefab Works designs are reserved exclusively to Park City Prefab Works and its authorized partners.
3. Attribution
Customers agree to reasonably credit Park City Prefab Works as the original designer in any public representation of the completed project where design attribution is customary.
4. Marketing Attribution
All Park City Prefab Works prefab structures must be identified as originating from and designed by Park City Prefab Works in all public-facing channels, including but not limited to social media, websites, marketing materials, and press publications.
This attribution requirement applies to customers and to any builder, contractor, or third party representing a Park City Prefab Works plan or prefab structure.
Any builder or third party who features, references, or depicts a Park City Prefab Works plan or prefab structure on a website or in any other public channel must accurately and conspicuously attribute the design to Park City Prefab Works.
Park City Prefab Works designs may not be presented as the original work of any customer, builder, or third party. Failure to provide proper attribution constitutes a violation of these Terms and Conditions.
5. Construction Responsibility
Customers are solely responsible for:
- Hiring licensed engineers, contractors, and other professionals, including those for foundations, electrical systems, utilities, heating, and plumbing;
- Obtaining code compliance and permits;
- Site-specific adaptations;
- All construction means, methods, sequencing, and execution.
Park City Prefab Works does not provide engineering, professional stamps, or construction oversight unless expressly stated in writing.
Final scope, pricing, and responsibilities are defined in the applicable Purchase Agreement.
6. Customer Responsibilities (All Projects)
The customer is solely responsible for:
- Permitting, zoning, and approvals;
- Site work, foundations, utilities, plumbing, heating, and electrical work unless expressly included in the Purchase Agreement;
- Contractor selection and jobsite safety.
Park City Prefab Works does not control on-site construction and is not responsible for construction outcomes.
7. Disclaimer and Limitation of Liability
All products and services are provided “as is” to the fullest extent permitted by law.
Park City Prefab Works is not responsible for:
- Permitting outcomes;
- Site conditions;
- Third-party engineering;
- Contractor performance;
- Cost overruns;
- Project delays;
- Construction defects.
Under no circumstances shall Park City Prefab Works be liable for any indirect, incidental, special, or consequential damages.
The maximum liability of Park City Prefab Works for any claim arising from the purchase or use of its products or services shall not exceed the amount paid by the customer to Park City Prefab Works.
8. Indemnification
Customers agree to indemnify, defend, and hold harmless Park City Prefab Works and its owners, employees, agents, and affiliates from any claims, damages, losses, liabilities, or expenses arising from:
- Construction activities;
- Site conditions;
- Code compliance issues;
- Third-party actions or omissions.
9. Package Deposits
Deposit Purpose
A package deposit:
- Allows the customer to engage in design selection and customization review; and
- Guarantees the customer’s selected package pricing for twelve (12) months from the date of deposit.
Refund Window
Deposits are fully refundable for twenty-one (21) days from the date of payment.
After the twenty-one (21) day period has expired, all deposits become non-refundable.
Pricing and Cost Expectations
Final project pricing is determined during the pre-construction phase and is based on project-specific factors, including but not limited to:
- Design selections;
- Site conditions;
- Customizations;
- Optional add-ons;
- Window and door upgrades;
- Engineering requirements.
The final project price and scope of work will be set forth in the Purchase Agreement, which shall govern all pricing and contractual obligations.
Park City Prefab Works may offer improved per-unit pricing for multi-unit projects based on volume efficiencies in procurement, manufacturing, and logistics.
10. Application of Deposit
Any deposit paid by the customer will be applied toward the purchase price of the selected prefab building package, subject to the terms of the applicable Purchase Agreement.
11. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Utah, without regard to conflict of law principles.
12. Updates to Terms and Conditions
The Terms and Conditions in effect on the date of purchase shall govern that transaction.
Park City Prefab Works reserves the right to modify or update these Terms and Conditions from time to time. Continued use of Park City Prefab Works products and services following any updates constitutes acceptance of the revised Terms and Conditions.
